Welcome to KindTail. These Terms & Conditions ("Terms") govern your access to and use of www.kindtail.com (the "Site"), including any purchases made through the Site.

The Site is operated by Chasing Monkey Inc., doing business as KindTail ("KindTail," "Company," "we," "us," or "our").

By accessing the Site, creating an account, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to make a purchase through the Site.

By using the Site or placing an order, you represent that you have the legal capacity to enter into a binding agreement.

2. Online Store

Our online store is hosted by Shopify and may rely on Shopify and other third-party providers to process transactions, payments, shipping information, analytics, and other services.

Your use of certain third-party services may also be subject to the terms and policies of those providers.

We reserve the right to refuse service, cancel transactions, limit quantities, or restrict access to the Site when reasonably necessary to protect KindTail, our customers, or our business.

3. Product Information

We make reasonable efforts to display our products, colors, dimensions, materials, features, specifications, and other information as accurately as possible.

However, product colors and appearance may vary depending on your device, monitor, lighting conditions, manufacturing variations, or other factors.

Measurements and weights may be approximate.

We may modify product designs, materials, specifications, packaging, or features from time to time, provided that such modifications do not materially misrepresent the product purchased.

Product images are for illustrative purposes and may include props, accessories, pets, or other items that are not included with the product unless expressly stated.

4. Orders and Acceptance

Submitting an order does not necessarily mean that we have accepted the order.

After you place an order, you may receive an email confirming that we received it. This acknowledgment does not constitute final acceptance of the order.

We reserve the right to accept, reject, limit, or cancel an order for legitimate business reasons, including:

Product availability;
Pricing or product-description errors;
Suspected fraud or unauthorized activity;
Payment authorization issues;
Shipping restrictions;
Orders that appear to be placed for unauthorized resale; or
Other circumstances that reasonably prevent us from fulfilling the order.

If we cancel an order after payment has been collected, we will issue an appropriate refund for the canceled portion of the order.

5. Prices and Payment

Prices are displayed in the currency indicated on the Site and are subject to change without notice.

Applicable taxes, shipping charges, duties, and other fees may be added to your order where required.

We make reasonable efforts to ensure that prices and promotions are accurate. If a product is mistakenly listed at an incorrect price, we may cancel the affected order and refund any amount paid, to the extent permitted by applicable law.

By providing payment information, you represent that you are authorized to use the payment method provided and authorize us and our payment processors to charge the amounts associated with your purchase.

6. Promotions, Discount Codes and Special Offers

From time to time, KindTail may offer discounts, promotional codes, gifts with purchase, bundles, contests, sweepstakes, sales, or other promotions.

Unless otherwise stated:

Promotions cannot be combined;
Promotional codes have no cash value;
Promotions may be limited by product, customer, order, geography, or time period;
Free gifts are subject to availability; and
Promotions may be modified or discontinued where permitted by law.

Additional terms may apply to individual promotions. If specific promotional terms conflict with these Terms, the specific promotional terms will control with respect to that promotion.

7. Shipping and Delivery

Shipping estimates provided on the Site are estimates only and are not guaranteed delivery dates unless expressly stated otherwise.

Delivery times may be affected by carriers, weather, holidays, inventory availability, customs, incorrect addresses, or circumstances outside our reasonable control.

Customers are responsible for providing accurate and complete shipping information.

If you believe your package has been lost, damaged, stolen, or incorrectly delivered, please contact us promptly so we can assist you in accordance with our applicable policies and carrier procedures.

Nothing in this section limits any rights you may have under applicable consumer protection laws.

8. Returns, Exchanges and Refunds

Returns, exchanges, refunds, and related eligibility requirements are governed by our Return & Refund Policy, as posted on the Site and updated from time to time.

Please review that policy before making a purchase.

Nothing in our Return & Refund Policy or these Terms is intended to limit any non-waivable rights available to consumers under applicable law.

9. Product Warranties

Certain KindTail products may be covered by a limited warranty.

Where applicable, the terms, eligibility requirements, exclusions, claim procedures, and duration of the warranty are described in our Warranty Policy.

Any written KindTail warranty is in addition to rights that cannot legally be excluded under applicable consumer protection law.

10. Pet Product Safety and Proper Use

KindTail products are designed for pets and should be used responsibly and in accordance with all instructions, warnings, sizing recommendations, and intended uses provided with the product or on the Site.

Pet owners are responsible for determining whether a product is appropriate for their individual pet based on factors including the pet's size, weight, behavior, temperament, health, age, and chewing or escape tendencies.

Pets should be appropriately supervised when using products where supervision is recommended.

No pet crate, carrier, bed, bowl, potty product, accessory, or other pet product is indestructible or suitable for every animal.

You should regularly inspect pet products for damage, excessive wear, loose components, chewing damage, or other conditions that could make continued use unsafe. Discontinue use if a product becomes damaged or unsafe.

KindTail products are not substitutes for veterinary care, professional animal training, or behavioral advice.

11. Crates and Containment Products

KindTail crates and containment products are intended to provide an appropriate space for pets when used properly.

Customers are responsible for selecting the appropriate product and size for their pet and for following applicable assembly, use, training, and safety instructions.

A crate should not be used as punishment or in a manner that could reasonably endanger an animal.

Animals with severe separation anxiety, destructive behavior, escape behavior, or other behavioral or medical conditions may require professional guidance before using a crate or containment product.

12. Intellectual Property

The Site and its contents, including without limitation:

The KindTail name and branding;
PAWD and other KindTail product names;
Logos;
Product designs;
Photographs;
Videos;
Illustrations;
Graphics;
Packaging;
Website design;
Copy and written content; and
Other intellectual property,

are owned by or licensed to Chasing Monkey Inc. and may be protected by copyright, trademark, patent, trade dress, and other intellectual property laws.

Nothing in these Terms grants you ownership of or a license to use our intellectual property except for the limited personal right to access and use the Site for lawful, noncommercial purposes.

You may not copy, reproduce, modify, distribute, sell, exploit, or create derivative works from our protected materials without our prior written permission, except where permitted by law.

13. User Content, Reviews and Submissions

You may have opportunities to submit reviews, photographs, videos, comments, feedback, social media content, or other materials ("User Content").

You retain ownership of your User Content.

By voluntarily submitting User Content directly to KindTail for publication or promotional use, you grant KindTail a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish that User Content in connection with operating, promoting, and marketing KindTail and its products, subject to applicable law.

You represent that you have the necessary rights to submit the User Content and that our permitted use of it will not violate the rights of another person.

Nothing in these Terms prohibits or restricts you from providing an honest review or expressing your genuine opinion about KindTail or our products.

We may moderate or remove content that is unlawful, fraudulent, abusive, threatening, obscene, infringes intellectual property rights, contains confidential or personal information, is unrelated to the product or service being reviewed, or otherwise violates applicable law or our reasonable content standards.

14. Prohibited Uses

You may not use the Site:

For unlawful or fraudulent purposes;
To violate applicable laws or regulations;
To infringe our intellectual property or the rights of others;
To transmit malware or malicious code;
To interfere with the security or operation of the Site;
To scrape, crawl, harvest, or systematically extract Site content without authorization;
To impersonate another person;
To submit false or misleading information;
To conduct fraudulent payment activity;
To circumvent purchase limits or promotional restrictions; or
To use automated systems to interfere with the normal operation of the Site.

We may suspend or terminate access to the Site where we reasonably believe these Terms have been violated.

15. Third-Party Websites and Services

The Site may contain links to or integrations with third-party websites and services.

KindTail does not control those third parties and is not responsible for their content, availability, privacy practices, security, or terms.

Your interactions with third-party services are governed by the terms and policies of those third parties.

16. Privacy

Your use of the Site is also subject to our Privacy Policy, which describes how we collect, use, disclose, and protect personal information.

17. SMS and Email Communications

If you choose to subscribe to promotional emails or text messages, you agree to receive communications in accordance with the disclosures presented when you subscribe.

Consent to receive marketing communications is not a condition of purchasing KindTail products.

You may unsubscribe from marketing emails using the unsubscribe mechanism provided in the email.

You may opt out of marketing text messages using the opt-out instructions provided in those messages.

Transactional communications relating to your orders, account, customer service inquiries, or other transactions may still be sent where permitted by law.

Additional SMS program terms may apply if KindTail operates a text messaging program.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WE DO NOT GUARANTEE THAT THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

EXCEPT FOR EXPRESS WARRANTIES PROVIDED BY KINDTAIL AND WARRANTIES OR RIGHTS THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, KINDTAIL DISCLAIMS WARRANTIES REGARDING THE SITE TO THE MAXIMUM EXTENT PERMITTED BY LAW.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHASING MONKEY INC., KINDTAIL, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE, EXCEPT WHERE SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO KINDTAIL FOR THE PRODUCT GIVING RISE TO THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Chasing Monkey Inc. and its officers, directors, employees, affiliates, and agents from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person's rights.

This section does not apply to the extent a claim results from KindTail's own unlawful conduct or where indemnification would otherwise be prohibited by applicable law.

21. Fraud and Unauthorized Transactions

We reserve the right to review orders for suspected fraud, unauthorized transactions, abuse of promotions, resale activity, or other suspicious activity.

We may request additional information to verify an order before shipment.

Where reasonably necessary, we may delay, limit, or cancel an order and issue an appropriate refund.

22. Resale

Unless otherwise authorized by KindTail in writing, products purchased through the Site are intended for personal use and not for commercial resale.

Wholesale customers, authorized retailers, distributors, and other commercial partners may be subject to separate agreements.

23. International Orders

International customers may be responsible for customs duties, import taxes, brokerage charges, and other fees imposed by the destination country unless otherwise stated at checkout.

International purchases may also be subject to mandatory consumer rights in the purchaser's jurisdiction.

Nothing in these Terms is intended to eliminate rights that cannot lawfully be waived.

24. Governing Law

These Terms and any dispute arising from them will be governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

Consumers residing outside California may also have rights under the mandatory consumer protection laws of their jurisdiction.

25. Informal Dispute Resolution

If you have a concern regarding an order, product, or the Site, we encourage you to contact us first so that we have an opportunity to resolve the issue.

Nothing in this section prevents either party from exercising rights or remedies available under applicable law.

26. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

27. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

28. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, Warranty Policy, and any additional terms expressly applicable to a purchase or promotion, constitute the agreement between you and KindTail regarding your use of the Site and purchases made through it.

29. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, products, services, technology, or applicable law.

When we update these Terms, we will revise the "Last Updated" date above.

Changes will apply prospectively from their effective date unless otherwise required by law.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
